So, the California Supreme Court upheld the constitutionality of Proposition 8 today, saying that taking away the right to marry, which the same court ruled was a fundamental right last year, is not actually fundamentally altering the state constitution and thus necessitating an amendment process as opposed to a simple referendum. The chief justice of the court, who wrote the opinion, said that gay couple still enjoyed all of the same rights under the new civil unions law, so nobody’s rights were taken away. The court, by taking such a “separate but equal is okay again” stance is really doing nothing more than proving its unwillingness to take on a heated issue and thus showcasing its irrelevance. Anywho, there are luckily more than a few people who were pissed off in the days following November 4th and it appears that those people are even more pissed off now. The doors to San Francisco City Hall have been officially blocked by angry people, but this is just the beginning. The opponents of same-sex marriage can continue to make their bigoted arguments; meanwhile, since the passage of Proposition 8, four more states have legalized gay marriage and New Hampshire seems to be on the cusp of doing so, as well. New York and New Jersey don’t seem to be too far behind, either. So, I’ll let NOM savor its victory today. But the storm is still gathering, the clouds are getting much darker, and they really need to watch out for lightning.
